《私募投资基金监督管理条例》7月9日正式对外发布。条例旨在鼓励私募投资基金行业规范健康发展，更好保护投资者合法权益，进一步发挥服务实体经济、促进科技创新等作用。

China published a regulation on July 9 concerning the supervision and administration of private investment funds. The regulation aims to encourage the standardized and healthy development of the private investment fund industry, better protect the legitimate rights and interests of investors, and encourage the industry to further play a role in serving the real economy and promoting scientific and technological innovation.

【知识点】

近年来，我国私募基金行业发展迅速，在直接融资比重、支持科技创新和产业转型升级、满足居民财富管理需求等方面，发挥着越来越重要的作用。数据显示，截至2023年5月，在中国证券投资基金业协会登记的私募基金管理人2.2万家，在基金业协会备案的私募基金15.3万只，基金规模21万亿元左右，居全球前列。长期以来，私募股权基金的监管上位法依据不足，对其规范主要依赖部门规章、规范性文件以及自律规则，监管执法依据和手段相对欠缺。随着资本市场改革深化以及行业发展的客观要求，到了需要重视并纳入上位法调整的阶段。

将于2023年9月1日起施行的《私募投资基金监督管理条例》是我国私募投资基金行业首部行政法规。条例的出台，有利于完善私募基金监管制度，将私募投资基金业务活动纳入法治化、规范化轨道进行监管，对私募基金行业规范健康发展、防范化解风险具有重要积极意义。条例规定，将契约型、公司型、合伙型等不同组织形式的私募投资基金均纳入适用范围，明确私募基金管理人和托管人的义务要求，规范资金募集和投资运作，特别规定国家对创业投资基金给予政策支持，强化监督管理和法律责任。

深化金融体制改革，建设现代中央银行制度，加强和完善现代金融监管，强化金融稳定保障体系，依法将各类金融活动全部纳入监管，守住不发生系统性风险底线。

We will reinforce the systems that safeguard financial stability, place all types of financial activities under regulation according to the law, and ensure no systemic risks arise.
