9月3日，《最高人民法院、最高人民检察院、公安部关于依法适用正当防卫制度的指导意见》(以下简称《指导意见》)发布，对于非法限制他人人身自由、非法侵入他人住宅等不法侵害，可以实行防卫( justifiable self-defense)。

The guideline, which was jointly issued by the Supreme People's Court, the Supreme People's Procuratorate and the Ministry of Public Security, aims to protect rights of good Samaritans and uphold justice by specifying the situations in which people's behaviors should be identified as justifiable self-defense.
该指导意见由最高人民法院、最高人民检察院和公安部联合发布，旨在准确理解和适用正当防卫的法律规定，依法维护公民的正当防卫权利，鼓励见义勇为。
最高人民法院研究室主任姜启波表示，先前一些司法机关模糊了是非界限(the line between right and wrong)，只因为一方受伤或死亡就给予支持(the side only because it suffered injuries or deaths)。但事实上，受伤或死亡的一方正是主动发起攻击的一方，或者首先损害了他人的合法权益(it was the side initiating attacks or it first harm others' legitimate rights)。
同时，姜启波指出，正当防卫在实践中很难认定，因为司法部门在适用上过于谨慎，标准也过于严格(the judicial departments were too cautious in the application and the criteria were too strict)。
他补充道，新的法律文件将有助于防止此类问题，也向公众表明，司法当局维护正义的决心( judicial authorities were determined to stand with justice)。
